Do I really need a DUI attorney? Can't I just take the plea?
You can. But a plea offered before your attorney reviews the evidence is usually built for the prosecutor's convenience, not yours. Even in cases where a plea is the right call, the terms are often negotiable — and there are almost always facts, procedural issues, or MVD angles worth examining before you agree to anything.
Is a first-offense DUI in Tucson really that serious?
Yes. Even a first misdemeanor DUI in Arizona carries mandatory jail (sometimes suspended), fines and fees typically over $1,500, license consequences, an ignition interlock requirement, and a permanent criminal record. Arizona is one of the strictest DUI states in the country.
What if my BAC was above the "extreme" or "super extreme" limit?
Higher BAC categories carry more mandatory jail and longer interlock requirements — but the number itself is still just evidence. Breath and blood results are challengeable, and the underlying stop or arrest may be too. A strong defense doesn't require pretending the number doesn't exist. It requires understanding how it was collected.
What if I refused the breath or blood test?
Refusal triggers a separate, longer MVD suspension — and the state can still get your blood by warrant. But it also changes what the prosecution has to prove at trial. Every refusal case is different, and the timing of the refusal matters.
How much does a DUI attorney in Tucson cost?
Fees vary based on the level of charge (misdemeanor vs. felony), whether there was an accident, whether there are prior offenses, and how far the case is likely to go. My Cost page walks through how I structure fees and what's included.
How fast do I need to hire someone?
Fast enough to preserve the MVD hearing request — you have 30 days from the arrest. Beyond that, the sooner an attorney is involved, the more can be done: preservation of evidence, early motion practice, and often a stronger position at the first court date.
